John Kerry Still Trying to Win Ohio

Returning to the state that dashed his presidential hopes in 2004, Democratic U.S. Sen. John Kerry rallied with college students on Tuesday for next's month elections, urging them to "Take back Ohio, take back our country."

"All of the things that make a difference in the real quality of life are going in the wrong direction," the senator from Massachusetts told about 300 supporters in the rally at Ohio State University.


Kerry, who conceded the 2004 election after he lost Ohio's 20 electoral votes, defended the Democrats Tuesday against accusations by Republicans that it has no ideas, citing plans by Democrats for health care, education, jobs, trade and global warming.

Ohio Democrats hope to gain this fall from a state scandal that has unfolded under Republican leadership that has hurt Gov. Bob Taft and others. Republicans control statewide offices, the House and Senate, and the Ohio Supreme Court.

Dems Hypocrites on Sex Scandals

While they react with fury over the scandal involving former Rep. Mark Foley, Democrats maintain a discreet silence over the numerous sex scandals that have rocked their own party.

And unlike Republican scandals like Foley's, where shame and resignation were the outcome, the Democrats' shameful behavior were either blithely ignored or jocularly accepted.

For example, former Chicago Democratic Congressman Mel Reynolds received a commutation of his six-and-a-half-year federal sentence for 15 convictions of wire fraud, bank fraud and lies to the Federal Election Commission. He also was convicted of having sex with an an underage campaign volunteer. But Jesse Jackson added Reynolds to Rainbow/PUSH Coalition's payroll.

Moreover, Reynolds was among the 176 criminals excused in President Clinton's last-minute pardon spree.

As Deroy Murdock, a columnist for Scripps Howard News Service, wrote back in 2002: "This is a first in American politics: An ex-congressman who had sex with a subordinate, won clemency from a president who had sex with a subordinate, then was hired by a clergyman who had sex with a subordinate. His new job? ... Youth counselor."

Of course, Murdock's "president" reference was to Clinton, who admitted to inappropriate sexual behavior with White House intern Monica Lewinsky; the "clergyman" was Jackson, who also had an affair with a former Rainbow/PUSH Coalition aide.

After receiving Clinton's pardon, Reynolds became a consultant for the Rainbow/PUSH Coalition on prison reform. He was employed as the community development director of Salem Baptist Church in Chicago.

More notorious was the case of Rep. Barney Frank, D-Mass., In 1989, male prostitute Stephen L. Gobie admitted that Rep. Barney Frank, D-Mass., knew that Gobie had operated a prostitution service out of Frank's Capitol Hill apartment. Frank, an openly gay member of Congress, confirmed that he had Gobie as a roommate in his apartment. Frank said he fired Gobie when he learned that clients were visiting his apartment.

Was Frank told by the Democratic leadership to resign his seat as Foley was forced to do?

Not at all. That was 17 years ago, and he is still a member of Congress, a respected member of the Democratic minority and is slated to assume the chairmanship of a key House committee should the Democrats recapture control of the House.

When former Rep. Gerry Studds admitted having sex with a teenage page, nobody in the Democratic leadership demanded he resign, nor did he offer to resign. He had a joint press conference with the boy and bragged about their affair. He was renominated by the Democrats and re-elected six times before retiring.

As Rush Limbaugh noted Monday, "The truth is that the people on the left who are acting all outraged and stunned and angry, they don't see what Clinton or Barney Frank or Gerry Studds did as repugnant. In fact, they view those things as private matters that didn't affect anybody's work, and it's nobody's business what somebody does with their private life, particularly when it comes to sex."

Unless it involves a Republican. Then it's a matter of outrage and hypocrisy.

Deportations avoided via DA's plea deals

Deportations avoided using "designer plea" -- Ritter OK'd pleas for 152 such defendants, some of whom were here legally. He says his office notified feds if they weren't.

The Denver district attorney's office under gubernatorial candidate Bill Ritter approved plea bargains that prevented the deportation of illegal and legal immigrants charged with drug, assault and other crimes.

The office allowed defendants to plead guilty to trespassing on agricultural land instead of the crimes they actually were accused of 152 times from 1998 through 2004. Other counties - Jefferson, Adams and Arapahoe - had only 75 convictions combined for the crime, according to court records.

Former Denver District Attorney Norm Early, who was Ritter's predecessor, laughed when he heard about the farm charges in urban Denver.

"I reviewed all my case dispositions, and I never remember that coming up," he said.

A review of 15 of the agricultural trespass cases in Denver showed that heroin and cocaine charges, theft of motor vehicles and domestic violence crimes - miles away from any farm or open land - were transformed into agricultural trespass.

"This plea agreement was reached with the the specific purpose of not pleading guilty to an offense that would subject (the defendant) to deportation proceedings," wrote a defense attorney in a motion filed in a Denver court Oct. 11, 2000.

The defendant, Ernesto Leon Reyes, was a resident alien who was initially charged with five drug counts related to his possession and intention to distribute 2,000 grams of methamphetamine.

If convicted of the drug charge, Reyes could have been deported after serving time. Instead, after pleading guilty to the trespass on agricultural land charge, Reyes received probation and stayed in the United States.

The review showed that illegal immigrants and a number of defendants whose immigration status was unclear entered into the same type of agreement.

Some were later charged with new crimes in Denver, indicating that they were never deported even after passing through Ritter's office.

Lynn Kimbrough, former spokeswoman for Ritter and current spokeswoman for Denver District Attorney Mitch Morrissey, said pleas to agricultural trespass are intended to be used primarily in drug crimes for legal immigrants.

"Usually when there are proof problems in the case," she said. "And because we have to balance our trial resources."

Ritter said that his office handled 38,000 cases during that seven-year period and agricultural trespass pleas made up less than 1 percent of them.

He also said he insisted his office contact immigration officials whenever a defendant was an illegal immigrant or had questionable immigration status.

"It was up to the federal government to deport them," Ritter said.

He also noted that the scarce resources in his office were used to prosecute violent and serious offenders and sometimes, cases had evidentiary issues where a plea to a lesser charge was better than losing at trial.

"We had 5,500 cases a year and seven judges," he said. "Our priority was to try the most serious cases."

Some probations broken
Among some of the deals extended by Ritter's office to illegal immigrants over the six years reviewed:

Emmanuel Acosta-Martinez, an illegal immigrant from Mexico, allegedly slapped his pregnant girlfriend in the face and repeatedly rammed his car into the back of another car in which his girlfriend was riding with another man in June 2001.

He was charged with criminal mischief and reckless endangerment. He pleaded guilty to the agricultural trespass charge and received four years' probation and was ordered to domestic violence classes. He failed to comply with the terms of his probation and was later arrested in Arapahoe County on burglary charges.

Finally, after the Arapahoe County case was resolved, he was to be deported to Mexico in 2004.

Alfredo Gamboa-Torres, an illegal immigrant from Mexico, was initially charged with two counts of drug possession with the intent to distribute. He pleaded guilty to agricultural trespass and received three years' probation and was not deported. At the time, he was already on probation for a DUI in Weld County.

Walter Ramo, an illegal immigrant from Honduras, was initially charged with the felony crime of sale and possession of heroin. He pleaded guilty to trespassing on farmland and received probation.

In a number of cases, defendants who entered into the agricultural trespass plea were born in other countries, but their immigration status is unclear.

In the case of Clemente Arambula, a 29-year-old from an unidentified country, he was charged with possession of a controlled substance but pleaded guilty to agricultural trespass. His court records note "no deportation."

Notes on status in files
Sometimes, police reports included the notation "refer to immigration"; in others, "immigration consequences" are noted by the court.

Denver Police Chief Gerry Whitman said officers generally make those notes when they arrest someone and find their documents altered, or if an interview determines there is a good chance they are in the U.S. illegally. Sometimes, he said, people admit to being in the country illegally.

In one case, a woman born in Mexico stabbed her husband in August 2002 and was charged with first-degree assault and menacing. She pleaded to the agricultural charge and received two years' probation.

A 24-year-old man born in Ciudad Juárez, Mexico, was charged in 2004 with theft and pleaded guilty to the farm charge, according to documents filed in the case by the district attorney's office. A note in the file said "refer to immigration."

That apparently didn't happen, because a few months later he was arrested in a gang-related drive-by shooting and charged with attempted murder. He remains in a Colorado prison with a parole hearing set for December.

Republican gubernatorial candidate Bob Beauprez, who has hammered Ritter on plea- bargaining illegal immigrants in the past, continued to do so Friday.

"It appears that he intentionally used a loophole to avoid enforcing the law," campaign manager John Marshall said.

Taking the felony hit
A number of crimes can result in the deportation of an immigrant who is in the U.S. legally but is not a citizen. They run the gamut, including those involving controlled substances, firearms, high-speed flight, domestic violence and those of "moral turpitude."

The latter has no statutory definition but has evolved through case law to include theft crimes, fraud and those with malicious intent, said Jeff Joseph, a Denver immigration attorney.

Trespassing on agricultural land with the intent to commit a felony usually does not fall into any of the deportable offenses, primarily because plea agreements often cite eavesdropping or other similar crimes as part of the underlying felony charge, according to Joseph and a review of court records. Those charges don't involve moral turpitude.

Joseph said the "designer plea" of agricultural trespass is not bending the law in favor of immigrants. In drug cases, for instance, American citizens often have the ability to plea to a lesser charge such as a misdemeanor or receive a deferred judgment.

But even a misdemeanor drug charge subjects an immigrant to deportation and hurts them if they later try to legally immigrate. Many immigrants would rather plead guilty to the felony agricultural trespass charge.

"They take the felony hit because it doesn't cause an immigration problem," he said. "It preserves their ability to come back."

You think everything wrong in the world is automatically Bush's fault and everything right in the world is automatically because of Clintoin.

You feel people should "share the wealth" (as long as your money is not the one being "shared".)

You think that being a Hollywood icon automatically means you are more "in tune" to world events than the leaders of the country.

You complain about the SUVs and other less-econmical cars, yet you parade around in a 5-mile-per-gallon limo.

You think that you can understand politics from Hollywood and activist celebrities without doing any research yourself.

You ban Tom Sawyer from schools for being "racist" but you approve of My Two Moms as wholesome and acceptable.

You think every solution to every problem can be solved with bigger Government.

You think people should be rewarded for laziness, but hard-working people should be taxed dry.

You frown upon self-thought and independent thought.

You think convicted criminals and democratic politicians who screw up are worth understanding and forgiving but conservative politicians and religious people who speak their opinion should be banned from public service.

You think that tolerance equals acceptance and anyone who doesn't accept a liberal cause is a racist or bigot.

You think terrorists and arsonists who burn down private property and harass businesses are noble but the troops who liberated Iraqis are war criminals.

You find charisma to be an appropriate replacement for honesty.

You find flashy rhetoric to be a suitable substitute for sincerity.

You poke fun at the "cookie cutter houses" in the suburbs, yet live in the city, in a giant brick building called an "apartment", no different from any other in the city.

You would rather have a President who spend his Administration caving in to terrorist demands in a frenzy to please and appease them, rather than a President who is fighting them to make the world a safer place for all.

And Finally...

You think Ralph Nader cares about consumers, Unions care about their members, the ACLU cares about civil liberties, the National Education Association cares.

About education, People for the American Way care about the American way, and Bill Clinton cares about anything other than Bill Clinton.

Roe v. Wade decision will be overturned, she predicts

In 1963, Dr. Alveda King’s uncle shouted the famous civil rights rallying cry, “I have a dream.”

Forty-three years later, King shared her own dream in Beckley -- that abortion in America will come to an end.

King, author of “Sons of Thunder: The King Family Legacy” and a former member of the Georgia House of Representatives, addressed the West Virginians for Life state convention Saturday morning at the Church of God Family Worship Center. She is the niece of slain civil rights leader Dr. Martin Luther King Jr. and the daughter of his brother A.D. King, who died in 1969, one year after her uncle was shot in Memphis, Tenn.

A.D. King, according to the Web site for the Atlanta-based King for America organization his daughter founded, was credited with organizing civil rights activities in Birmingham, Ala., and Louisville, Ky. Homes he had in both cities were bombed during the heat of those struggles.

“‘I Have a Dream’ is in my genes, you know?” Alveda King said Saturday. “It is in our hearts and in our lives. So is the word of God.”

King said in 1973 the Roe v. Wade decision legalizing abortion was handed down by the U.S. Supreme Court, and at that time, she believed the country had a quiet, sleepy attitude, and it pushed God away. However, she believes the country is waking up.

“Roe v. Wade will come down -- it will happen,” she said.

“Martin Luther King Jr. said the Negro cannot win if he is willing to sacrifice the lives of his own children for his comfort and safety. ... Nobody can win if we sacrifice our children for our own personal comfort and safety.”

As a younger woman, King had two abortions, one she said was performed with her consent and one without.

“I’ve wondered if it was a boy or a girl. Did it hurt the baby?” she asked.

Until she became a born-again Christian in 1983, King said she considered herself pro-choice. Sometime in the late 1970s, she became pregnant again. At that time, she again considered abortion, but the child’s father and King’s grandfather were vehemently against it. She did not have the abortion, and that child will be 30 years old in January.

“I have six living children, two aborted and one miscarried,” she said.

In 1983, King made the decision to live for Jesus Christ and, she said, pursue the truth. When she taught law classes in college, she proposed this question to her students: If a woman wants an abortion, where is the lawyer for the child? Some students protested this teaching, but she found that other young people believed they were not being presented this argument.

As a woman who has had an abortion herself, King stressed to the audience that forgiveness is just as important in the pro-life movement. Many people -- women and men alike -- now regret past decisions to either have abortions or pressure a woman into having one.

“If you have never had an abortion, praise God, but be a good friend to someone who did,” she said.

King’s birthday is Jan. 22, the day the Roe v. Wade decision was handed down. She hopes that one day she is not reminded of that decision on her birthday.

As of now, women can decide whether to terminate a pregnancy. King urged them, regardless of the circumstances, to not choose abortion. She said she was speaking from the experiences of a woman who was traumatized from abortions who, at the time, did not know what would happen to her afterward.

“Choose life,” she said. “Life is too precious to be taken for granted.”

Allegations Trip Up Voting Rights Group

COLUMBUS, Ohio -- An advocacy group that registered more than a million voters two years ago is wrestling with new allegations of voter fraud and sloppy work just weeks before crucial midterm elections.

In Philadelphia, the city's voter registration office has rejected about 3,000 cards submitted by the Association of Community Organizations for Reform Now since April because of missing information or invalid addresses.

Election officials in three of Ohio's largest counties have cited problems with hundreds of voter registration cards. ACORN is accused of submitting cards with nonexistent addresses, forged signatures and, in one case, for someone who died seven years ago.

"In my opinion, there's a lot of words but little action in terms of fixing the problem," said Matt Damschroder, elections board director in Franklin County in Ohio.

County election officials in Denver forwarded about 200 cards to the secretary of state's office after discovering identical handwriting on signatures. Colorado officials investigated similar problems two years ago.

ACORN, which has about 220,000 members nationally, registered 1.2 million people to vote in 2004 and is running voter registration drives in 17 states this year.

The nonprofit dispatches workers and volunteers to poor neighborhoods, gas stations, courthouses and other places to sign up new voters.

Voter registration has become a battle cry for parties and advocacy groups in recent years. Democrats hope to regain control of the U.S. House and narrow or erase the GOP majority in the Senate on Nov. 7.

ACORN also was accused of fraud in 2004 in Ohio, Florida, Minnesota, North Carolina and Virginia, and in 2003 in Missouri.

Prosecution is rare, and federal lawsuits against the group were dismissed in Florida. ACORN says it's working to reduce problems, and officials promise to fire any workers found committing fraud.

"We'll continue to personally encourage people to register to vote and exercise their franchise, and we're going to continue to stand up for people's voter rights," said Kevin Whelan, a spokesman for the New Orleans-based group.

Such statements do little to appease critics. Even groups supporting the organization's efforts question why fraud allegations keep cropping up.

"They're sort of their own worst enemy," said Bill Faith, who directs Ohio's largest homeless advocacy group and shares many of ACORN's goals.

"They want low-income people to register to vote but because of the kind of problems that come from their program, it provokes a reaction from the Legislature that actually makes it harder to run such programs," Faith said.

The Denver Election Commission says it's been unsuccessful in working with ACORN to reduce problems with voter registration cards.

ACORN says it meets regularly with election officials to address concerns.

"We hold our workers to a very high standard, we ensure they make every vote count and we're going to continue to do that work," said Ben Hanna, head organizer in Colorado.

In Ohio, prosecutors are looking at almost 400 cards that the Franklin County elections board says included already registered voters or people with the wrong address.

The elections board is also looking at hundreds of other ACORN cards with alleged irregularities. The Hamilton County board is concerned about errors and missing information on hundreds of ACORN cards, while problems with about a dozen cards were reported in Summit County.

Meanwhile, ACORN continues its largely successful legal campaign to reduce voting obstacles for the poor. In September, a federal judge in Ohio threw out a requirement that individuals who register voters -- instead of groups -- must turn in the completed forms, in a lawsuit brought by ACORN and other voting rights groups.

ACORN won a preliminary victory Thursday in a similar suit against Georgia's voter registration laws. It won a similar case in Washington state this year and in Maryland last year.

ACORN employee Carlos McCoy recently stood in a steady rain outside the Franklin County Courthouse, politely but assertively asking person after person if they were registered to vote.

Only 17, McCoy has worked at similar jobs since 2004. The high school senior spent a few days registering voters for $9 an hour before school started.

He attributes problems with other ACORN workers to inexperience and asking the wrong questions. He says he took the job for the money but also because he likes being involved in politics and community organizing. A resident of the city's poor south side, he says the work affects his life.

"You want where you live to be taken care of," McCoy said.

Democrats Want to Revive Soc. Sec. Issue

WASHINGTON -- Social Security has drifted out of the national debate, but Democrats, eyeing the senior vote, are trying to revive the issue -- just in time for the midterm elections.

Democratic leaders are advising their party's congressional candidates to focus on what the Republicans might do to Social Security given the chance.

"The president hasn't given up yet, even though the American people resoundingly rejected his proposal for private accounts," said House Minority Leader Nancy Pelosi, D-Calif.

Politicians from both parties acknowledge Social Security is likely to face insolvency in future years as the population ages, although they don't agree on the solutions.

Overhauling the landmark New Deal program to aid seniors was President Bush's postelection goal in 2004. His proposal called for allowing workers under age 55 to divert some Social Security taxes into personal accounts in exchange for lower guaranteed benefits.

Democrats, labor and senior groups strongly opposed private accounts. And Republican unease about the program was enough to kill it, a major defeat for the president.

But a number of groups are working to keep the issue alive.

Social Security advocates are holding dozens of events around the country challenging Republicans to sign a pledge that they will not support efforts to create personal accounts.

Americans United, a labor-backed group formed to fight Social Security changes, plans to follow politicians who favor private accounts -- including GOP Sen. Rick Santorum of Pennsylvania -- with campaign workers dressed as gorillas carrying the message, "Don't monkey with our SS."

Another group, "For Our Grandchildren," is sending out a competing pledge to candidates asking that all options be considered to save Social Security, said Tim Penny, a former Democratic congressman from Minnesota.

"It's always been a reliable issue for the Democrats," said Ross Baker, a political scientist at Rutgers. "The problem is that when the president was trying to sell it it was an issue, but it has receded so much."

Still, Democrats believe the phrase "Social Security" will be heard by voters 50 and over, despite the loud debate over terrorism, Iraq and the economy. These voters in 2002 made up almost half of the electorate, according to exit polls.

Senior voters have swung back and forth in recent elections, backing Republicans in 2004 and leaning Democratic in current AP-Ipsos polling.

"I don't want to see Social Security changed," said 64-year-old retiree Elaine Skelenger, a political independent from Milford, Pa. "It's something I've never forgotten about."

After the administration's Medicare prescription drug program failed to produce problems for Republicans, the Democrats view Social Security as a way to as away to energize seniors at the polls.

And Republicans have made clear they're not giving up on changing the program.

In June, Bush said in a speech that he remains determined to make changes in the Social Security system, as well as other federal programs like Medicare. "If we can't get it done this year, I'm going to try next year," he promised.

House Majority Leader John Boehner, R-Ohio, has said in interviews that he wants to bring up Social Security again next year.

And Rep. Jim McCrery, R-La., who heads a House Ways and Means panel dealing with Social Security, has promised to "come up with a Social Security plan that we can all embrace -- Republicans and Democrats."

Republican pollster Whit Ayres said Democrats are using their standard game plan: "When in trouble Democrats go back to scaring seniors about Social Security."
